Any dispute arising out of these TOU shall be subject to the exclusive venue of the state and federal courts within the Northern District of California, and You and the SFAAB hereby consent to the venue and jurisdiction of such courts.
B. These TOU contain the entire agreement and understanding between You and the SFAAB with respect to the subject matter hereof. In no event will any additional terms or conditions be effective unless expressly accepted by the SFAAB in writing.
C. If any provision of these TOU is held to be invalid by a court of competent jurisdiction, then the remaining provisions will nevertheless remain in full force and effect.
D. The SFAAB may modify these TOU by posting notice of such modifications on this page. Any modification is effective upon posting, unless otherwise indicated .
E. You agree that, if the SFAAB does not exercise or enforce any legal right or remedy contained in these TOU (or that the SFAAB has the benefit of under any applicable law), this will not be taken to be a formal waiver of the SFAAB's rights and that those rights or remedies will still be available to the SFAAB. Any waiver of any provision of these TOU will be effective only if the SFAAB expressly states in a signed writing that it is waiving a specified provision.
All editorial and creative assets on this Site, include the code used to create web pages, are protected by U.S. and International copyright laws. The SFAAB reserves all rights to this content.
3. MATERIAL USE
You may not incorporate the Material for any purpose into another database, search engine, any other web site or in a networked computer environment of any kind . You may not copy or adapt the HTML code that SFAAB-OL creates to generate its pages. Access to this Site is monitored. The requesting URLs, the machine originating the request and the time of the request may be logged for access statistics and security purposes. Use of this Site constitutes consent to such monitoring.
4. USER INFORMATION
SFAAB-OL may also make improvements and/or changes in the services described in this Site at any time without notice. Material on this Site may be changed, terminated, or updated without notice.
Any information or material sent to SFAAB-OL shall not be considered confidential. By sending SFAAB-OL any information or material, You acknowledge such information is subject to public inspection and you grant SFAAB-OL license to use such information for its business purposes.
5. SCOPE OF PERMITTED SITE USE
You may refer to the URL of this Site without limitation, but You may not link to this Site. The Site may only be used for lawful assessment appeals purposes. SFAAB-OL specifically prohibits any use of the Site, and all Users agree not to use the Site, for any of the following:
A. Posting or transmitting any message, information, data, text, software or images, or other material that may invade another's privacy or publicity rights or is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or otherwise objectionable in the opinion of SFAAB-OL.
B. Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available from SFAAB-OL on this Site and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer).
C. Using any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site and/or taking any action that imposes an unreasonable or disproportionately large load on this Site's infrastructure.
You may not use the Site in order to transmit, distribute, erase, or store material: (a) in violation of any applicable law or regulation; (b) in a manner that will infringe the patent, copyright, trademark, trade secret or other intellectual property rights of SFAAB-OL or others or violate the privacy, publicity or other personal rights of others; or (c) that is harmful, defamatory, libelous, vulgar, obscene, threatening, abusive, harassing or otherwise objectionable in the opinion of SFAAB-OL. 6. SECURITY / NO DISRUPTION
You are responsible for all activities that occur under Your password, Personal Identification Number (PIN), and account, and will keep Your password(s) and PIN confidential. You will immediately notify us of any unauthorized use of Your password, PIN, or account or any other breach of security. You will not disrupt the functioning of this Site, solicit another user's password or PIN, or otherwise act in a way that interferes with other users' use of this Site.
7. TIMELY SUBMITTAL OF APPLICATIONS AND PAYMENTS
It is your responsibility to ensure that applications and filing fee payments are successfully received by the San Francisco Assessment Appeals Board by 11:59 p.m. on September 15th. If the filing date specified in this subdivision falls on Saturday, Sunday, or a legal holiday, an application and filing fee payment received by 11:59 p.m. on the next business day shall be deemed to have been filed within the requisite time period specified in this subdivision. If your application and/or filing fee payment is posted after the September 15th deadline as a result of a failed transaction or for any other reason, your application will not be accepted as a timely filed appeal and will, therefore, be rejected.
8. LINKS TO OTHER MATERIALS
The linked sites are not under the control of SFAAB-OL and SFAAB-OL is not responsible for the content of any linked site or any link contained in a linked site. SFAAB-OL reserves the right to terminate any link or linking program at any time.
9. PROPRIETARY INFORMATION
Certain portions of this Site contain material that is considered confidential and proprietary . Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent, copyright, trademark or other intellectual property right of SFAAB-OL or any third party.
SFAAB-OL's logos and trademarks identify our products and/or services, and may never be used, copied or redistributed.
A. In no event shall the SFAAB be liable for any direct, indirect, incidental, consequential or special damages (including without limitation, loss of use, time or data, inconvenience, commercial loss, lost profits or savings, or the cost of computer equipment and software), to the full extent that such may be disclaimed by law, or for any claim against You by any third party. In no event shall the SFAAB be liable for any claim, including claims by third parties, for loss or damages arising from erroneous data or information contained on the Site.
B. To the fullest extent permitted by law, You shall indemnify and save harmless the SFAAB, from any claim, loss, damage, injury or liability of any kind, nature and description (including, without limitation, incidental and consequential damages, court costs, attorney’s fees and costs of investigation), that arise directly or indirectly, in whole or in part, from Your use of the Site. In addition to Your obligation to indemnify the SFAAB, You specifically acknowledge and agree that You have an immediate and independent obligation to defend the SFAAB from any claim which actually or potentially falls within this indemnification provision, even if the allegations are or may be groundless, false or fraudulent, which obligation arises at the time such claim is tendered to You by the SFAAB and continues at all times thereafter.

If any provision of these TOU are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these TOU, which shall remain in full force and effect.
No waiver of any term of these TOU shall be deemed a further or continuing waiver of such term or any other term. No changes to these TOU shall be made except by a revised posting on this page. Any rights not expressly granted herein are reserved.

14. ENTIRE AGREEMENT.
You acknowledge that You have these TOU, understand it and agree to be bound by these provisions. These TOU contain the entire agreement and understanding between You and the SFAAB-OL with respect to the subject matter hereof and completely replace and supersede any prior agreements, proposal, representation or warranty between You and SFAAB-OL regarding Your use of the Online Filing Service.

For additional security purposes, the application for the assessment appeal will be electronically signed.
By use of the Personal Identification Number (PIN) to electronically sign this appeal application, you certify (or declare) under penalty of perjury under the laws of the State of California that all information herein, including any accompanying statements or documents, is true, correct, and complete to the best of your knowledge and belief and that you are the owner of the property or the person affected (i.e., a person having a direct economic interest in the payment of taxes on that property – "The Applicant")
